Abstract
The La Yarada aquifer, located in the driest area of the Peruvian coast and head of the Atacama Desert, is characterized by its extreme scarcity of water resources. The analysis was carried out between the closure and the control of the degradation of the aquifer, identifying three interrelations; rapid growth of unauthorized extraction, dispersed and uncontrolled nature, abrupt decline and attempts to create a specific governance of groundwater, concluding that by 2019, the aquifer situation is chaotic, the imbalance is very high –144.09 Hm3/year Well drilling, despite the legal provisions in force, has continued to occur indiscriminately. The governance and governability crisis is becoming more marked and the Peruvian state does not have the appropriate tools to enforce the provisions regarding the ban. The implementation of a ban in 1989 on the incorporation of new wells and ratified in 1998, could not control the degradation of the aquifer. Likewise, the D.S. Nº 007-2015-MINAGRI, is contradictory and inapplicable as it cannot be granted a license on a non-existent resource (negative balance), this ratifies the fragility of the state, to implement mechanisms that allow compliance with the provisions of the R.M. Nº 0555-89-AG/DGAS and its ratification by R.M. Nº 696-98-AG declaring the closure of the aquifer.
