Abstract
In this study the authors set forth the conditions under which Peruvian judges may disregard binding precedents decided by the Constitutional Court, in the exercise of their judicial independence. After reviewing international and domestic jurisprudence established by competent constitutional review bodies, the authors argue that judges may disregard binding precedents if their decision includes specific parameters.
